Terms of Service

By using nisk.ai ("the Service"), you agree to these terms. If you do not agree, do not use the Service.

1. Nature of the Service

nisk.ai provides AI-generated suggestions, coaching, and analysis in real-time. The Service does not provide professional advice. Specifically:

• It is not legal advice. Legal alerts and contract analysis are informational only. Consult a licensed attorney for legal matters.
• It is not medical advice. Any health-related suggestions are for informational purposes only. Consult a qualified healthcare provider.
• It is not financial advice. Shopping, negotiation, and deal suggestions are general guidance only. Consult a financial professional for financial decisions.
• It is not emergency services. The SOS feature provides safety tips and quick-dial access, but is not a substitute for calling emergency services (911, 112, etc.).
• AR overlay features (emotion detection, document scanning, live captions) provide AI-generated estimates and are not professional assessments. Do not rely on emotion ring readings for psychological evaluation or scanner results for official document verification.
• Battle Mode is designed for fun and entertainment. Debate scores are AI-generated and should not be taken as objective measures of argument quality.
• Practice Mode is for training and rehearsal purposes only. Practice session feedback is AI-generated and should not be treated as professional coaching certification or evaluation.
• Watch Spotter is for entertainment and general reference only. Watch identification, valuations, and authentication suggestions provided by the AI are not professional appraisals. Always consult a certified watchmaker or appraiser for official authentication, insurance, or resale purposes.
• AI coaching in general: nisk.ai provides AI-generated suggestions to assist your conversations. It does not replace professional advice. nisk.ai is not liable for any decisions you make based on coaching suggestions. You are solely responsible for the outcomes of conversations in which you use the Service.

2. No Guarantee of Accuracy

AI-generated content may be inaccurate, incomplete, or inappropriate for your specific situation. nisk.ai makes no warranties about the accuracy, reliability, or completeness of any suggestions, analyses, fact-checks, or translations provided by the Service. You should independently verify any information before acting on it.

3. User Responsibility

You are solely responsible for how you use the suggestions and information provided by nisk.ai. This includes:

• Deciding whether to follow or disregard any suggestion
• Ensuring your use of the Service complies with applicable laws
• Obtaining consent from other parties when recording or analyzing conversations, as required by your jurisdiction
• Any consequences resulting from actions you take based on the Service's output

4. Service Provided "As-Is"

The Service is provided "as-is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

5. Third-Party Services

nisk.ai relies on third-party services to function:

• Anthropic API — AI analysis is subject to Anthropic's usage policies and terms of service.
• Deepgram — Speech-to-text processing is subject to Deepgram's terms of service.
• ElevenLabs — Voice synthesis is subject to ElevenLabs' terms of service.
• Serper — Web search and fact-checking is subject to Serper's terms of service.
• Supabase — Account and data storage is subject to Supabase's terms of service.
• Stripe — Payment processing is subject to Stripe's terms and privacy policy.
• Microsoft Clarity — Analytics are subject to Microsoft's privacy statement and terms of use.

We are not responsible for the availability, performance, or policies of third-party services.

6. Payments and Subscriptions

• Free users have access to basic features with usage limits.
• Paid plans (Session Pass, Pro) unlock higher usage limits and additional features.
• All payments are processed securely through Stripe. We do not store your payment details.
• Refunds may be requested within 7 days of purchase by contacting support@nisk.ai. Refunds are granted at our discretion.
• We reserve the right to change pricing with 30 days notice to existing subscribers.

6a. Gift Credits

nisk.ai offers gift codes that can be redeemed for in-app credits. By redeeming a gift code, you agree to the following:

• Non-refundable: Gift credits have no cash value and cannot be refunded, exchanged for money, or transferred to another account once redeemed.
• Single-use: Each gift code can only be redeemed once. Attempting to redeem an already-used code will result in an error and no credits will be awarded.
• Expiry: Gift codes may have an expiration date. Expired codes cannot be redeemed. Check the code for any stated expiry.
• Not for resale: Gift codes may not be resold or transferred for value.
• Fraud prevention: We reserve the right to revoke credits obtained through fraudulent means, abuse of the gift code system, or violation of these terms.
• Referral credits: Credits earned through the referral program are also non-refundable, non-transferable, and may be revoked if the referral is found to be fraudulent.

7. Minimum Age

You must be at least 13 years old to use nisk.ai. If you are between 13 and 18, you should have a parent or guardian's permission. We do not knowingly allow users under 13 to access the Service.

7a. Kids Mode & Parental Responsibility

nisk.ai offers a Kids Mode for supervised use by minors aged 13–17. If you enable Kids Mode for a minor in your care:

• Parental responsibility: The parent or guardian who enables Kids Mode is responsible for supervising the minor's use of the Service and ensuring it is appropriate for their age and maturity level.
• Not a substitute for supervision: Kids Mode applies content filtering, but AI-generated content is not perfect. Do not rely solely on Kids Mode to protect minors from inappropriate content. Active supervision is recommended.
• Account responsibility: If a minor uses your account or a shared device, you (the account holder) are responsible for all activity and any credits used.
• Data: No special data is collected when Kids Mode is active beyond standard app preferences stored locally. See our Privacy Policy for details.
• No accounts for under-13: Do not create an account for or allow access by anyone under 13, even in Kids Mode.

8. Acceptable Use

You agree not to use nisk.ai to:

• Engage in illegal activity or facilitate illegal conduct
• Harass, abuse, threaten, or harm others
• Attempt to reverse-engineer, exploit, or compromise the Service
• Overwhelm the Service with automated or excessive requests
• Use the decoy or stealth features for unlawful surveillance

9. Account Termination

We reserve the right to suspend or terminate access to the Service at any time, without prior notice, for conduct that we determine violates these terms or is harmful to other users, us, or third parties. Since nisk.ai stores data locally on your device, termination means blocking access to the Service's API endpoints.

10. Limitation of Liability

To the maximum extent permitted by law, nisk.ai and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the Service, even if we have been advised of the possibility of such damages.

11. Indemnification

You agree to indemnify and hold harmless nisk.ai and its creators from any claims, damages, losses, or expenses arising from your use of the Service or your violation of these terms.

12. Changes to These Terms

We may update these terms from time to time. Changes will be posted on this page with an updated date. Continued use of the Service after changes constitutes acceptance of the updated terms.

13. Governing Law

These terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles.

14. Recording & Consent Disclaimer

nisk does not record, store, or transmit audio from your conversations. All speech is processed in real-time and immediately discarded. nisk functions as a real-time note-taking and coaching assistant. Users are solely responsible for complying with all applicable local, state, and national laws regarding conversation assistance, recording consent, and wiretapping in their jurisdiction. By using nisk, you confirm that your use complies with all applicable laws in your location.

15. AI Disclaimer

nisk provides AI-generated suggestions for informational and entertainment purposes only. nisk is not a licensed attorney, financial advisor, medical professional, or therapist. Do not rely on nisk's coaching as professional advice. nisk is not liable for any decisions made based on its suggestions. Always consult qualified professionals for legal, financial, medical, or therapeutic matters.

16. Lie Detector Disclaimer

The Lie Detector feature is for entertainment purposes only. It uses voice pattern analysis which is not scientifically validated for determining truthfulness. Do not use Lie Detector results to make real decisions about trust, relationships, or business. nisk makes no claims about the accuracy of this feature.

17. Watch Spotter Disclaimer

The Watch Spotter feature provides AI-assisted visual analysis for educational and entertainment purposes only. It is not a professional authentication service. Always consult a certified watchmaker or authentication expert before making purchase decisions.

18. Contract Scanner Disclaimer

Contract Scanner provides AI-assisted document analysis for informational purposes only. It is not legal advice. Always have contracts reviewed by a qualified attorney before signing.
